1. Acceptance of these terms
These Terms of Use govern your access to the website and services of New York Comprehensive Wellness Management, LLC (“NYCWM,” “we,” “us,” or “our”). By using the website or requesting services, you agree to these terms and our Privacy Notice. If you do not agree, do not use the website or services.
2. Our service
NYCWM provides physician-led behavioral health planning, navigation, and care coordination for individuals and families. We may help clarify goals, organize a multidisciplinary plan, identify independent clinicians or programs, facilitate communication, and review the plan as needs evolve.
NYCWM does not diagnose, prescribe medication, provide psychotherapy, administer TMS, or deliver other clinical treatment. Information from NYCWM is for planning and coordination and is not medical advice or a substitute for evaluation or treatment by a licensed clinician.
3. Independent clinicians and programs
Clinicians and clinical organizations introduced through or working alongside NYCWM are independent unless a written agreement expressly states otherwise. They remain solely responsible for their assessment, treatment recommendations, prescribing, documentation, billing, informed consent, and care delivery. NYCWM does not control their clinical judgment and does not guarantee that any particular clinician or program will accept an inquiry or be available.
4. No emergency or crisis service
The website and NYCWM inquiry channels are not monitored for emergencies and should not be used for urgent or crisis needs. If you or someone else may be in immediate danger, call 911. In the United States, you may also call or text 988 for the Suicide & Crisis Lifeline.
5. Your responsibilities
You agree to provide accurate contact and scheduling information; use the website lawfully; respect the privacy and rights of others; make clinical decisions with qualified clinicians; and avoid submitting patient-identifying information, treatment records, diagnoses, medication lists, or other sensitive health information through a public website form unless NYCWM specifically provides a secure method and requests it.
6. Introductions, availability, and outcomes
Any provider or program information is offered to support your decision-making and is not an endorsement, guarantee, or representation that a service is appropriate for a particular person. Acceptance, availability, fees, insurance participation, clinical fit, and treatment decisions are determined by the independent clinician or organization. NYCWM does not guarantee outcomes.
7. Privacy
Our Privacy Notice describes how we handle information. HIPAA status depends on the function performed and the parties’ relationship. NYCWM may act as a business associate of a HIPAA covered entity in an engagement where the services and a written business associate agreement require that role; not every website inquiry or relationship is governed by HIPAA.
8. Website content and acceptable use
The website and its original content, branding, and design are owned by or licensed to NYCWM and are protected by applicable law. You may use the website for personal, noncommercial informational purposes. You may not disrupt the site, attempt unauthorized access, introduce malicious code, scrape personal information, impersonate another person, or use the site to violate law or another person’s rights.
9. Third-party services and links
The site may link to or use services operated by Squarespace, form providers, independent clinicians, clinical organizations, or other third parties. NYCWM does not control those services and is not responsible for their content, availability, security, or privacy practices. Review the terms and notices of the third party you use.
10. Disclaimers and limitation of liability
To the extent permitted by law, the website and planning and coordination services are provided without warranties of a particular clinical result, provider availability, or uninterrupted website operation. NYCWM is not responsible for clinical decisions, treatment, acts, omissions, or records of independent clinicians or organizations. Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Changes
We may update these terms as the website, services, or applicable requirements change. The “Last updated” date identifies the current version. Changes apply prospectively when posted unless a different date is stated.
